Ways to take revenge to those “liars”!

I had emphasised how to identify “Liars” or lawyers” in my previous post  https://malaysiadivorcelawyer.blogspot.com/2021/01/are-you-hiring-lawyer-or-liar.html . The easiest way to identify them as ”liars” is they  would normally like to incorporate their companies under “Sdn. Bhd.” .Whereas, Malaysia legal firms are mandatory to run legal firms by way of sole proprietor or partnership.

Why i will come out with this post ?

I want to vent out my anger here after my SME legal team group noticed that many SME companies have been encountering a number of big problem during and after  MCO 1.0 and MCO 2.0 such as :-

 

(A) employees threaten to sue the employers for not getting full salaries;

(B) employers forced employees to take unpaid leave and annual leave; or

(C) many employers forced to close down and yet live in fear that the ex employees will take legal action against them in future.

Well, the issue that is able to trigger my anger is many of those SME bosses showed us their agreements yet we found out that those agreements are not really able to apply in  their industries or many of the agreements are those standard  “ employment contracts “ that can simply copy and paste from google template or Employment Act 1955.

Those template and irrelevant agreements are:-

 

(A) given after they attended business consultancy classes for 3 days 2 nights;or

(B) hired legal consultants who runs their businesses under Sdn. BHd.

BOSSes, this pandemic is a waking call to all of us. It is a time for us to think twice before we pay for any services . You have to hire somebody at least :-

 

(A) is a qualified practising lawyer;

(B) world is changing why you want to pay somebody who is “out dated “ in law industry to draft your agreements;

(C)look for someone who has reported cases in Industrial Court or Labour court (they know the current law and what the courts want from time to time);and

(D) someone at least takes the lawyer’s  brief case,  goes to court and knows the law well

Therefore, it is time to put down the “greed” and think there is nothing call “discount” or “gift” in term of agreements . This “greed” will directly create “unnecessary fear “ in your life.

Are you hiring a “lawyer” or a “liar “?

AS a co-leader of our SME legal team , during pandemic i realised that many SME bosses are trying their upper best to restructure and rearrange the systems and policies of their companies to embrace the new challenges that indirectly forced by the “pandemic”.Undeniably this is a good move and good change to endure the new world.

Many young and new bosses especially those who graduated from oversea will start hiring lawyers to review and even draft corporate documents and commercial agreements to regulate the internal and external relationships of their companies .

However , many of them wasted their money to hire a team of  “liar “instead  of a group of professional lawyers . This is a serious issue that we shall highlight to all of you as according to section 37 of Legal Profession Act 1976 in Malaysia , none of the unauthorised person is allowed to wilfully or falsely pretends to be by taking name of title to act as a qualified lawyer to  do the followings :-

 

(A) draft any corporate &commercial agreements including to prepare any documents or instruments relating  to incorporation or formation a company;

(B) draft trust , Power of attorney , S& P Agreement and issue out any threatening letters to demand for outstanding sum for a company or individual;

(C) to draft any cause papers to file into court;

(D) accept any consultation fee or retainer fee by giving legal advise ;

(E) as anything related to legal service or act as an advocate & solicitor in Malaysia is considered he/she is committing a crime unless those services given are under “Free of Charge” and you shall bear the liability by acting or complying with their advices since they do not possess any lawyers’ licenses while those advices were given to anyone of you.

You shall google the entire section 37 Legal Profession Act.

There are 3 tips for you to know whether you are hiring a “liar” or a “lawyer” in Malaysia :-

1. Malaysia lawyers do  not allow to practise under Sdn. Bhd or LLP as we are only allowed to practise under partnership or sole proprietorship  till today;

1. You can search the name of the firm or the name of the lawyer via our Malaysia Bar website:-https://www.malaysianbar.org.my/article/find/legal-directories/lawyer-or-law-firm/lawyer-or-law-firm
2. A lawyer who possesses a law degree doesn’t mean he /she is a legally practise lawyer while he or she doesn’t exist in the website as stated in item 2 .

You pay for the  legal services and you are looking for help , you have to make sure you are looking at the  right door and the right person to serve you .

Time to bid goodbye to “liar” in our market, do not fool by those sweet talks and great marketing business skills. Your job is you have to do your own thorough research and share this knowledge among your friends and family members.

Have you set your 2021 resolutions?

I am a person who always looking forward the 1st month of every year . It is a new month that let you and me to restart a new year with new goal (s) and even new dream(s). I always start setting up my new year resolutions 2 months before the new year, because I want to be productive and do not want to waste a little second to my life in this world.How about you ?

I will always do some research, self -evaluation including evaluating  all my legal teammates to ensure everyone will be motivated to set their own resolutions to welcome a new year .

I always set 2 kinds of goals  and i did encourage all my teammates will do the same :-

 

(A) contentment & happiness ;and

(B)accomplishments &commitments

Both in workplace and personal life as striking a balance within (A) &(B) are extremely important in everyone’s life.

Well, this year I start to focus my blogspot and i do hope that I have  my time to share about my personal life as a Divorce Lawyer in Malaysia, a managing partner inside the firm and also a leader to lead my litigation department and a co-leader in the SME legal team .

I strongly hope that  I will be more focus the improvement and the development of those young lawyers in my legal firm especially in their career path to uplift their skills and life instead of keep “focusing about my own achievements and endless breakthrough in my own career path”.

It is time to learn how to contribute, plan for others instead of being too calculative or too focus on myself from head to toe.

Plan vs goal

 

I came across one of  my seniors’ insta profile  and I couldn’t agree more with her that it is good to plan ahead to everything rather than no plan.

We can change our plan when it is not workable but no matter how we shouldn’t simply change our goals.

We shall set goals for us to move forward and resolution is a kind of methodology  to let us go nearer to our goals.

2021

It is a brand new year no matter our country is in the state of emergency and MCO is implementing in every state except Sarawak. Let us get ready to embrace the challenges ahead. Plan our new journey and embark our journey confidently .say goodbye to negative thoughts and endless fear that all of us may face in 2021.

离婚时最怕“乱”和“害怕”

                                  

不管男女， 没有人会要走到“离婚”这个终点，

不管男女， 都会思来想去，

都会设法想办法挽回或解决，

这段路没有谁不纠结不无奈不幸苦。

感情如此脆落， 有时甚至不攻自破，

好多生活里的芝麻小事，

不轻易的就都可能是感情分裂的导火线。

我呢？和你们不一样的是我被迫留下遗憾，

死神不让我纠结，不让我有机会设法挽回或解决，

我脑海里永远的记忆是在他离开前，

大家都是在感情里最美好，

对未来充满着希望的时候，被迫的画上了句点。

我想恨，但记忆太美，我想找理由怪罪他，

但所有的一切我清楚已他无关， 也许当下的他也有好多遗憾和不舍的。

人生如戏，戏如人生，

多少人翻回过往，不知觉的变成戏里的男女主角，

才叫人觉得又可悲又好笑。

有谁不心烦意乱， 有谁承担得起，

“分开”这决定，也是个终身决定？

有谁不害怕甚至特有勇气面对？

“离婚”后接下来的生活又是如何？

有孩子的就更加叫人心烦，甚至不知所措。

我当下，看到尸体从我身边被移走时，

心里从空白突然也想到如何面对接下来的生活，

害怕刚有点起步的事业，会不会就就这样没了，

情场刚落空的我，

还得承受屋子车子的贷款。

 

我当时完全不懂刚起步的事业走向如何，

一个月能换来多少钱？足不足够还贷款？

我完全迷茫， 虽然很感恩合伙人大方说律师楼的钱，

一部分让我还房贷，然而当时刚开William， Florence &Partners，

到底每月能不能足够温饱3餐还是个问号。

环境突发的改变， 害怕和混乱也是个必经过程，

当下得我也不知是怎么熬过来，

大概是那个很用心很努力的心，

都把中心全放在事业的冲吧！

有时想多了只会让自己又害怕又慌乱，

说真虽然没多少人能做到“随遇而安”和“顺其自然”，

然而往往从困境中成功找到中心点和方向，

莫过于就是自己内心接纳和领受这8个字。

离婚后最大的克星-空洞

人生对我来说空虚空洞是件可怕的事，

回到过去的爱窝，脑海中不停浮现以往甜蜜的画面，

那些画面就算再甜再美，

你我依然回不去，

会不自觉怨恨自己或那个她/他，

或是有些后悔当初的决定，

都是对自己内心最大的伤害。

别看不起这个触景伤情的小画面，

它就有本事让你害怕回这个家，

它就有本事弄到你不想回家，

它就有本事让你彻夜不眠，

夜深人静了， 

这些甜蜜和过去都是不停折磨你我情绪和精神的武器。

以前为了这个爱窝，

你我多累都为了“幸福”和“未来”不停前进，

今天的我就算在这爱窝这房间，

痛哭一场，这房子这房间，

依然空空荡荡。

当时的我选择在事业里打拼，

一天做足17个小时，

只想麻醉在忙碌的生活，让自己劳累，

好让自己晚上能好好入眠。

朋友看到我一年出国五次，

觉得我的生活是他们的梦想，

有谁了解当时的我，

像在逃亡一样， 努力习惯的填补自己的生活。

人生啊如果只看表面，

那样应该都太美好了，

多少表面下的内层，

都是完好无损呢？

好多离婚当下或离婚后的顾客，

不是靠酒精让自己入睡，

有些甚至更需要安眠药的帮忙，

让自己好眠，大家都不堕落，

大家其实都想自救，

毕竟这种精神折磨，不是看看书，

解解压就能解决。

一些人甚至随便找个他/她，

怀念一下那个温度那个被呵护的感觉，

但是却好多人都发现到最后，

自己又那样不小心把自己和另个人给刺伤了。

毕竟怀念这件事，

有时付出的代价，

也很高。

这就是个过程，就是个必经之路，

是不管你多坚强多聪明，

都无法避免和逃脱的一个环节。

你我都是凡人，

这一切是来到凡间的一种修炼。
